What is and what is the difference between an Eviction, Unlawful Detainer and Ejectment?

Eviction:

*    Governed by Ch. 83

*    Landlord/tenant relationship, usually established by a written or oral lease

*    Summary procedure under FS 51.011, filed in county court

*    Filing fee $185 + $10ea. summons issuance fee (does not include sheriff/service fees)

Unlawful Detainer (different than eviction):

*    Governed by Ch. 82

*    Applies to situations where friends, family members, significant other, and other folks are allowed to stay on-premises for a certain time or under certain conditions, with no obligation to contribute money, and then refuse to leave at the agreed time or after the violation of some condition.

*    No rental agreement, no landlord/tenant relationship, the only issue is possession

*    Summary procedure under FS 51.011, filed in county court

*    Filing fee $300 + $10ea. summons issuance fee (does not include sheriff/service fees)

Ejectment:

*    Governed by Ch. 66

*    Not a summary procedure, must be filed in circuit court

*    Plaintiff must prove that he/she has a valid title to the premises; the plaintiff can be only the purported owner.

*    Defendant claims some right, interest or title to the property - something more than possession

*    Filing fee $400 + $10ea summons issuance fee (does not include sheriff/service fees)
