A Risk Protection case is filed by the Sheriff or any law enforcement agency.

They are filed when Law Enforcement Agencies fear or have evidence that the respondent may be a threat to themselves or others (similar to a Baker Act) only the respondent is not taken into custody for psychological evaluation. If an order is entered/granted into the case, any firearms are removed from the respondent. A preliminary and final hearing are typically scheduled upon entry of the order granting.
