What if I can't appear at my traffic hearing?

If you have a traffic ticket and plead not guilty you can attend court in person at your own expense or be heard by way of an affidavit of defense. 

An affidavit of defense is a written affidavit of events and is true and correct as if you were present in the courtroom. The clerk's office does not have a form to provide.  You may write your written defense to indicate what you would say if you were in attendance at the court hearing.

Your affidavit of defense should be notarized. 

You may hand deliver, mail or e-file (through Florida e-filing portal) your affidavit prior to your hearing date. To register for the Florida e-filing portal go to www.myflcourtaccess.com
