Unclaimed Funds? Is there a list for public view of unclaimed funds? What is the process to claim money in the court registry?

The unclaimed funds list is published/advertised annually in an Okaloosa County circulated newspaper.  

The publication is run in the month of July and claims must be received on or before September 1st of the same year or the funds are declared forfeited. This publication includes non-adjudicated funds i.e. cash bonds; non-resident cash bonds, garnishment deposits; un-cashed refund checks; un-cashed juror checks; un-cashed restitution checks; clerk vendor payments and civil cash bonds per FS 116.21.

If you wish to file a claim you may complete the "Claim for unclaimed funds" form. This form is available on the clerk website during the claim time duration. Find form here: https://www.okaloosaclerk.com/wp-content/uploads/Unclaimed-Funds-Form-8.5.21.pdf.

The claim form must be notarized prior to submission.

The clerk sends letters out each year to parties on each case where there are funds being held in the court registry. In the letters, it instructs the person wanting to claim the money to:

            Submit a motion and proposed order to the clerk; ensure there is a case number on their pleadings and include an accurate mailing address.

 Upon filing, the clerk will send the proposed order to the assigned Judge on the case.

It will be up to the Judge if they are granted the money. No funds can be released without a court order.
