If you meet the Florida poverty guidelines, you may complete an indigency application in all case types. There are three separate applications as follows:
Civil Indigency Applications are utilized in civil cases (Circuit Civil, Small Claims, County Court, Family Law, Probate and Guardianship) when the applicant is not a current inmate or prisoner. NOTE: for simplified dissolution of marriage both parties must complete an application and each must be determined to be indigent.
Criminal Indigency Applications are utilized by defendants who are seeking to obtain a public defender and have fees deferred in a criminal case (Felony, Misdemeanor, Criminal Traffic and Juvenile Delinquency).
Prisoner Affidavit and Applications for Indigency are utilized for current inmates or prisoners when filing civil cases (Circuit Civil, Small Claims, County Court, Family Law, Probate and Guardianship).
The applications and their determinations are effective until the disposition or closure of the case. Any subsequent motion or request for judicial action will require a new application to be completed. Please note some applications may have a fee associated with them when filing.
