What is the next step after a 5-day summons is served? Must show proof of service in the case before the next step.

There must be proof of service- return of service filed/scanned in the case before the clerk can issue a default.

If the case does not show proof of service of the 5 day summons, contact the OCSO to have it filed first.  

If an answer is not filed, the landlord can ask for a default after 5 business days have passed. If no answer and/or no money deposited the clerk has the authority to enter the default. The landlord can then request an order of removal of judgment.

If an answer is filed by the tenant the Judge will determine if it will be set for hearing or enter a Final Judgment for removal of tenant.
