REDUCEABLE TRAFFIC INFRACTION

Effective July 1, 2010 (violations on or after) 

Citations issued for the following violations can no longer be dismissed. However, if the defendant presents proof of repair or correction by affidavit of law enforcement officer inspection, the disposition will be reported as “Paid Fine – TR only (Guilty)” but the total civil penalty will be reduced to $93. If the defect is not corrected within 30 days of the citation, the standard civil penalty of $113 applies.

Proof and payment prior to the court date, if criminal offense, excuses defendant from court appearance. This option can only be used once in a 12-month period and 3 times maximum lifetime. SIDE NOTE: The DHSMV requires any operator cited for running a red light, failure to yield right of way to vehicle or pedestrian, failure to stop for a school bus - to complete a Department approved 4-hour basic driver improvement (BDI) course.  All drivers, except CDL holders, and those convicted of criminal offenses listed under s. 322.0261(4) may elect to attend a BDI course in lieu of points; this election will also satisfy the school requirements of s. 322.0261(4). Therefore, if the driver is eligible and elects to attend school for one of the above non-criminal violations, the Department will withhold points and count that election as having satisfied the requirements of 322.0261(4).
